Before becoming a registered member of CharlesDems.Org, please review the following terms and conditions which define your rights, responsibilities and benefits as a member of our site.
CharlesDems.Org License and Terms and Conditions of Use
CharlesDems.Org (hereafter “the Site”) is owned and operated by the Democratic Central Committee of Charles County, MD (hereafter “the Committee,” "we," "our," or "us"). The site exists to support the Committee and the social welfare of Charles County by sharing information and photographs or digital images of interest to Committee members and the public. "You" or "your" means a registered member on the CharlesDems.Org web site. Both adults and minors may have access to and register on the Site. Minors may only register on this site with their parent’s or guardian’s permission and their registration and use of the Site is contingent on their parents’ or guardian's affirmation of permission. Your registration and use of this site indicates that you are bound by this agreement with us. If you don't agree with any of these terms and conditions, please don't register or use this site. We may alter this agreement at our discretion, and your continued use after any change indicates your acceptance of that change. If you don't want to be bound by a change, cancel your registration and do not use the Site.
CharlesDems.Org contains graphics, information, data, editorial and other content (the content) accessible by any Internet user and similar content which is accessible only to members of the Site. In the freely accessible areas of the Site, all Content is owned and/or copyrighted by Committee members or third party providers and may be used only in accordance with this limited use license. Material posted to private site areas or public pages controlled by persons who created those public pages is owned by the person who created the material posted and is hosted by CharlesDems.Org under the license contained in this Agreement. The Committee members are protected by copyright, for individual elements in the case of content provided by CharlesDems.Org, and as a collective work and/or compilation as to the Site as a whole, pursuant to U.S. copyright laws, international conventions, and other copyright laws.
Limited Use License
You are licensed to use the Site and its Content only for your personal use and the use of the other members of the Site. The Site is not intended for or licensed for any commercial use. Commercial use is specifically prohibited and attempts at commercial use will result in forfeiture of your license to use this site. The download of the whole or significant portions of any functionality of the Site, or any part of the public areas of the Site is prohibited. On line or other republication of Content in the public areas without permission is prohibited. Violation of this License may result in immediate termination of your membership. You may use access software provided on the Site only while on line and may not download, copy, reuse or distribute that software, except where it is clearly stated in connection with software that it is made available for offline use or redistribution and a license for that use is provided in connection with that software.
User Provided Content
Submission and Use: Portions of the Site will contain user provided content, to which you may submit appropriate content. The Committee is the sole determiner of "appropriate content" and reserves the right, acting in accordance with Committee bylaws, to not publish and reject any user provided content without reason or explanation. By submitting content to CharlesDems.Org, you grant the Committee a limited license to use, host, and distribute the content. You should submit only content which belongs to you and will not violate the property or other rights of other people or organizations. We are sensitive to the copyright and other intellectual property rights of others. We will be inconsistent in providing copyright notice for content on the site, so consider all content on this site provided by us, our members, or third parties to be under the protection of copyright. Be aware that all content on the Site, including any photographic image, belongs to the creator or submitter and you should not reproduce it without permission of the owner. We will not edit, without user approval, user submitted content, with the exception that we reserve the right to edit digital images submitted to the Site solely for the purpose of controlling image resolution, dimensions, and file size. Such edits will be made, at our discretion, to ensure the images display properly on the Site and to conserve file storage space on the Site. We will notify you in the case of such edits and you may appeal the image modifications and/or delete the image/s if modifications are not acceptable to you. Final determination on the acceptability of file size and resolution will be made by Us.
Fitness of Content: The CCDCC is a continuing campaign finance entity. Our web Site exists to assist in raising funds to support the Democratic Party and to foster community, collegiality, and happiness among members and visitors. As stated above we reserve the right to reject any user provided material without reason or explanation. Moreover, we WILL reject or remove any user provided content which comes to our attention and which we believe, at our sole discretion, is illegal, obscene, indecent, defamatory, incites racial or ethnic hatred, is sexist in nature, violates the rights of others, offends our sense of propriety and/or fairness, that is inconsistent with the purpose of the Site, or otherwise violates this Agreement.
Access to and Perpetuity of Content: We purchase hosting services for this site from a third party hosting service. We must comply with the terms and conditions of the hosting service, and the availability of this site is controlled by the actions of the hosting services as well as us. We have purchased finite storage for content from the hosting service. If we encounter storage space limitations on the Site, we will, at our sole discretion, select content to remove from the Site to stay within our storage space limitations. We will notify you if your content is about to be or has been deleted.
Liability Disclaimer
The information, products, and services included on this Site may include inaccuracies or typographical errors. Changes are periodically added to the information herein. We provide all Content on this Site "AS IS", and without any warranty of any kind.
We make no representations concerning the suitability, reliability or accuracy of the Content or the service provided on the Site for any purpose. We disclaim all warranties, expressed or implied, in connection with the Content and the services provided on the Site, including conditions of merchantability, fitness for a particular purpose, title and non-infringement. In the case of goods or services purchased via the Site, any warranty is supplied by the manufacturer and we provide no such warranty. In no case will we be liable for any direct, indirect, punitive, special or other damages including, without limitation, lost or delay of use, lost profits, loss of data or any other damage in contract, tort, equity or any other legal theory, even if advised of the possibility thereof.
We may, from time to time, provide opportunities to users of the Site to link to or buy services from third parties. Sites of those third parties may be subject to terms and conditions which are different from those found here. CharlesDems.Org makes no warranty concerning third party provided goods or services and you agree that any recourse for dissatisfaction or problems with those goods or services will be sought from the third party provider and not from CharlesDems.Org
Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, this limitation may not apply in part to you.
IF YOU ARE DISSATISFIED WITH ANY PORTION OF THIS SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THIS WEB SERVICE.
Additional Member Terms
REGISTRATION AND SECURITY
Registration is restricted to persons with valid email and U.S. postal addresses. As part of the registration process, you will select a password and Member name ("Username"). You must provide CharlesDems.Org with accurate, complete, and updated registration information. Failure to do so will breach this Agreement. You understand that you may not (i) select or use a name of another person with the intent to impersonate that person; (ii) use the Rights of any person other than yourself without authorization; or (iii) use a name that we, in our sole discretion, deem offensive.
You shall notify us by regular mail of any known or suspected unauthorized use(s) of your membership, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information. You will be responsible for maintaining the confidentiality of your password. You are responsible for all usage or activity on CharlesDems.Org via your password. Distribution of your password for access to CharlesDems.Org by others is expressly prohibited and shall constitute a breach of this agreement. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your membership, at our sole discretion. You will never be required to reveal your password to any representative or agent of CharlesDems.Org, its owners or agents.
You must be 18 years or older, or, if acting for a minor, grant permission as parent or guardian for that minor, to become a member. Logging in as a member of CharlesDems.Org is confirmation that the person logging in is an adult or has received permission from a parent or guardian to become a member of a site and/or to use the Site.
MODIFICATIONS TO THIS AGREEMENT AND THE SITE
CharlesDems.Org has the right, at its sole discretion, to modify this Agreement or the Site at any time. Changes in service will be posted on CharlesDems.Org, or sent via e-mail to you. If any portion of this Agreement or any change of this Agreement of the Site is unacceptable to you or will cause you to no longer be in compliance with the Agreement, you should discontinue use of the Site. Continued use of the Site now or following changes in this Agreement means that you have accepted and are bound by the changes.
MISCELLANEOUS
Obviously, if any part of this agreement is inconsistent with the laws of Maryland, Utah (where our hosting service resides) or any other relevant jurisdiction, then those laws prevail over these terms and conditions.
